Intra-EU invoicing (EU clients)

For business clients established in another EU Member State, invoices are issued without VAT under the reverse charge mechanism (article 21 §2 of the Belgian VAT Code, directive 2006/112/EC). The client must provide a valid intra-EU VAT number, verified via the VIES system of the European Commission. Services are reported quarterly in the Belgian intra-EU operations statement.

For individual clients established in the EU, the Belgian VAT rate of 21% applies by default, unless the distance-selling threshold of €10,000/year is exceeded, in which case the VAT of the consumer country applies via the OSS one-stop shop.

Applicable law and jurisdiction

This legal notice, as well as any contractual relationship between Metropole Inv. SRL (Pixel Noir) and its clients, regardless of their country of residence or establishment, is governed by Belgian law.

Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of the judicial district of Brussels, French-speaking chambers, subject to the mandatory consumer protection rules applicable in the country of habitual residence of the individual client (Rome I Regulation and Brussels I bis Regulation).

For business clients (B2B), the jurisdiction of the Brussels courts applies without exception, in accordance with the contractual freedom provided for by the Rome I Regulation.

Out-of-court dispute resolution

In accordance with EU Regulation No. 524/2013, the European Commission provides an online dispute resolution platform available at ec.europa.eu/consumers/odr. In Belgium, the Consumer Mediation Service may also be contacted: mediationconsommateur.be.

Missed-revenue simulator
